When influencer gifting and product seeding require disclosure

Free products, discounts, travel and other benefits may create a relationship that needs clear disclosure.

THE SHORT ANSWER

When a creator receives free or discounted products, commission, travel, tickets or another valuable benefit, determine the local and platform disclosure requirements. The FTC states that free or discounted benefits may require disclosure even when the brand did not ask for a mention. Before shipping, state whether content is required, preserve honest opinion, explain disclosure expectations and record the arrangement; local legal application needs qualified review.

Separate no-guarantee seeding from contracted deliverables

No-guarantee seeding gives a product without buying a posting commitment; contracted work defines content, date and compensation. Both need a record of what the brand provided, but budgeting, agreement and follow-up differ.

Do not turn no-guarantee seeding into an implied obligation through repeated pressure after shipping. If content is required, agree deliverables and compensation first.

Disclosure should be easy for ordinary viewers to understand

Disclosure should appear close to the endorsement, in language ordinary viewers understand, and remain visible in video, live or multi-frame content. A profile-only note, buried hashtag or ambiguous “collab” may not explain the relationship.

Platform tools help, but the brand still needs to check the final presentation. FTC and ASA/CAP guidance emphasizes that audiences should be able to recognize the commercial relationship.

Provide accurate facts without dictating experience

Provide product name, specifications, instructions, warnings and prohibited claims. Do not ask creators to describe an experience that did not occur or use review to alter an honest opinion.

For health, finance or other regulated categories, arrange specialist review before seeding and preserve the published version and disclosure evidence.

Record the benefit and outcome separately

Store ship date, product value, delivery status, whether content was required, disclosure guidance, actual publication and later rights. No publication is not missing data; it is a possible result of no-guarantee seeding.

Track delivered products, organic mentions, contracted posts and reusable assets separately in QuickKOL. Costs and outcomes become comparable only when similar programs use the same definitions.

Separate “no payment” from “no relationship”

FTC influencer guidance states that free or discounted products and other benefits may create a material relationship, and disclosure can be needed even when the brand did not ask for a mention. It also says disclosure should accompany the endorsement and remain hard to miss, rather than being buried in a profile, behind “more” or among hashtags.

Record what was provided, value, whether content was required, market, disclosure guidance, actual post and evidence. For UK work, review ASA/CAP guidance as well. Jurisdictions and categories can add requirements, so the operational process should define when local legal review is needed instead of applying one disclaimer everywhere.
